Silent Auction Terms and Conditions
By submitting a bid, you are agreeing to the silent auction’s terms and conditions.
These terms and conditions should be posted in a couple places around the silent auction and especially at the check-out area.
All sales are final. There are no exchanges or refunds, and items such as travel or special events are not transferrable, unless otherwise stated or authorized by the Love for Lewiston Foundation (the “Foundation”).
Unless otherwise stated, successful bidders are responsible for making any travel and booking arrangements directly with the service provider(s) of the auction item. The Foundation is not responsible for any cancellations or changes.
Restaurant gift certificates do not include tax or gratuities, unless otherwise stated.
Payment for all items purchased must be made in full by cash or credit card on the night of the auction. In the event that a credit card charge is not approved, the successful bidder remains liable for all amounts owed. You must pick up all physical items the night of the auction unless alternative arrangements are made in advance. Any item that remains unclaimed at the end of the night may be sold at a subsequent auction, with the proceeds to go to the Foundation.
The Foundation accepts no responsibility for the authenticity, condition, correctness of descriptions or other matters affecting any item in any manner. All items (including travel and special events) are “as is”. No representation, warranty or assumption of liability, expressed or implied, is made by the Foundation in connection with any of the auction items, notwithstanding any statements to the contrary.
The purchaser assumes all risks and hazards associated with the auction and the items purchased at the auction. The purchaser agrees to indemnify and hold the Foundation, its directors, officers, employees and agents harmless from and against any liability for property or physical injury that may arise from any item or service acquired at the auction.
Any applicable taxes will be charged on all purchases in accordance with federal and provincial legislation.
Live Auction – a declaration of sale by the auctioneer will constitute a binding contract for the purchase of the particular item by the successful bidder. If there is a dispute, the decision of the auctioneer is final.
